Welcome to DuradMedical. These Terms of Service (“Terms”) govern your access to and use of the DuradMedical website and membership (the “Service”), operated by Creed and Companies LLC (“DuradMedical,” “we,” “us”). By creating an account or using the Service, you agree to these Terms.
1. What DuradMedical is — and isn’t
DuradMedical is an educational resource and organizational tool for people who use home respiratory and durable medical equipment (DME) and their caregivers. We help you keep track of your devices, supplies, and replacement dates, and we provide general educational content.
DuradMedical is not a medical provider, pharmacy, or DME supplier. We do not sell, rent, service, or prescribe equipment, and we do not provide medical care. Nothing on the Service is medical advice, and using the Service does not create a doctor–patient relationship. Always follow the instructions of your own physician, care team, and equipment manufacturer. See our Medical Disclaimer. In an emergency, call 911 or your local emergency number.
2. Eligibility & accounts
You must be at least 18 years old to create an account. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account.
3. Membership, trial & billing
DuradMedical offers a paid membership with a free trial. Key terms:
- Free trial: New members receive a 42-day free trial. You are not charged during the trial.
- Adding a card early (“lock in $4.99”): If you add a payment method during signup, your membership is set to $4.99/month, and you are not charged until the trial ends.
- Starting without a card: If you start the trial without a card, you may add a card any time before the trial ends to lock in $4.99/month. If you continue after the trial without locking that rate, the price is $7.99/month.
- Annual option: An annual membership is available at $49/year, billed annually and renewing automatically until you cancel.
- Auto-renewal: Paid memberships renew automatically at the then-current rate until you cancel. By providing a payment method, you authorize us and our payment processor (Stripe) to charge it on a recurring basis.
- Billing date: Your first charge occurs at the end of your 42-day trial, on the date disclosed to you at signup, and on that same day of each billing cycle thereafter.
- Price changes: We may change membership pricing; a locked-in rate stays as described above. We will give notice of any change to your rate before it takes effect, as required by law.
Payments are processed by Stripe; we do not store full card numbers. See the Cancellation & Refund Policy for how to cancel and what happens when you do.
4. Cancellation
You can cancel at any time from your account settings. If you cancel before your trial ends, you are never charged. See the Cancellation & Refund Policy for details.
5. Free vs. paid access
Some features require a paid membership. If your trial ends without an active paid membership, or you cancel, your account moves to the free tier: paid features become locked, but your saved information is retained, not deleted, and becomes available again if you resubscribe.
6. Acceptable use
You agree not to misuse the Service, including by attempting to access other members’ data, disrupting the Service, scraping, reverse-engineering, or using it unlawfully. We may suspend or terminate accounts that violate these Terms.
7. Your content
You retain ownership of the information you enter (such as your devices and dates). You grant us a limited license to store and process it to provide the Service. We handle personal information as described in our Privacy Policy.
8. Intellectual property
The Service, including our content, guides, and branding, is owned by DuradMedical or its licensors and is protected by law. We grant you a personal, non-transferable, non-exclusive right to use the Service for its intended purpose.
9. Disclaimers
The Service and all content are provided “as is” and “as available,” for general educational and organizational purposes only, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the content is complete, current, or suitable for your specific medical situation. Reminders and dates are conveniences, not a guarantee — you remain responsible for your own equipment, supplies, and care.
10. Limitation of liability
To the fullest extent permitted by law, DuradMedical and its owners are not liable for any indirect, incidental, or consequential damages, or for any health outcome, arising from your use of the Service.
11. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you (for example, by email or on the site) before they take effect. Continued use after changes take effect means you accept the updated Terms.
12. Governing law & contact
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules.
